What to Do When the FBI Is Knocking At Your Door

You’ve seen it often enough on TV and in movies, but you have no idea how you would handle it if an FBI agent knocked on your door. What should you do or say to make sure you are treated fairly and that all of your rights are protected?

The Time to Find Out Is Now

You won’t have time to search the internet while there is an FBI agent at your door. Instead, the time to figure out how to handle the situation is now—before the FBI is anywhere near your home. If you find yourself with an FBI agent outside of your New Orleans home in the future, then it is important to:

  • Be polite. You won’t get anywhere by being rude.
  • Ask to see a search or arrest warrant before allowing the agent into your home. Generally, you only have to allow an FBI agent into your home if the agent has an arrest warrant or search warrant.
  • Stay quiet in response to questions. You may confirm your name and address, but do not answer any other questions. Anything that you say can be used against you.
  • Document who made the visit, what was asked of you, and how the visit went. This includes the agent’s name and badge number. Write down the types of questions the agent asked and make note of the attitude of the agent. If you were threatened or hurt in any way then be sure to document that as well.
  • If a search of your home is made, stay there to witness it, or have someone else witness it, and document what happens. What did they take? Did they follow the terms of the search warrant? These things may be important later.
